TERMS AND CONDITIONS

GENERAL

These Terms & Conditions apply to all orders placed with GINA MELOSI. By placing an order, you agree to be bound by these terms.

We reserve the right to update or modify these Terms & Conditions at any time. The version in force at the time of your order will apply.

ORDERS & AVAILABILITY

All orders are subject to acceptance and availability.

Once an order is placed, you will receive an email confirmation acknowledging receipt. This does not constitute acceptance of your order. A contract is formed once your order has been dispatched.

We reserve the right to decline or cancel an order in certain circumstances, including where payment authorisation cannot be obtained, an item is unavailable, or an error has occurred in pricing or product information.

PRICING & PAYMENT

All prices are listed in EUR.

Prices are displayed excluding VAT. The applicable VAT rate will be calculated at checkout based on your location.

Orders shipped outside the European Union are not subject to VAT.

Payment must be received in full before an order is processed and dispatched.

SHIPPING & DELIVERY

GINA MELOSI ships internationally using Deutsche Post, DHL, and UPS.

Delivery times are provided as a guide and may vary depending on destination and customs processing.

For international orders, local import duties and taxes may apply upon arrival. These are determined by local authorities and are the responsibility of the customer. These charges are not included in the purchase price or shipping costs.

GINA MELOSI is not responsible for delays caused by customs clearance processes.

All shipments are insured while in transit. A signature may be required upon delivery. Responsibility for the goods transfers to the customer upon delivery.

RIGHT OF WITHDRAWAL (WIDERRUFSRECHT)

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day on which you, or a third party named by you (who is not the carrier), took possession of the goods.

To exercise your right of withdrawal, you must inform us (GINA MELOSI, hello@ginamelosi.com) of your decision to withdraw from this contract by means of a clear statement (e.g. email).

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

EFFECTS OF WITHDRAWAL

If you withdraw from this contract, we will reimburse all payments received from you, including standard delivery costs (excluding any additional costs resulting from your choice of a different delivery method), without undue delay and no later than 14 days from the day on which we are informed of your decision.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earlier.

You must return the goods without undue delay and no later than 14 days from the day on which you inform us of your withdrawal.

You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods if this results from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

RETURNS & EXCHANGES

To initiate a return, please contact hello@ginamelosi.com. Returns sent without prior authorisation will not be accepted.

Returned items must be sent in their original packaging, or equivalent protective packaging. The customer is responsible for any damage caused by inadequate packaging.

For international returns, packages must be clearly marked “Returned Goods” to avoid customs charges.

Refunds will be issued to the original payment method within 14 days of receiving the returned item, or once proof of return shipment has been provided (whichever is earlier).

Shipping costs are refundable only for standard delivery. Any additional shipping upgrades are non-refundable.

Return shipping costs are the responsibility of the customer.

EXCLUSIONS

The following items are not eligible for return or withdrawal:

  • Bespoke or customised pieces

  • Sale items

  • Earrings (for hygiene reasons)

BESPOKE ORDERS

For bespoke commissions, a non-refundable deposit of 50% is required to begin production. This covers materials and production time.

The remaining balance must be paid in full before dispatch.

By confirming a bespoke order (in person, via email, or telephone), the client agrees to these terms.

PRODUCT INFORMATION

All pieces are handcrafted. Variations in texture, form, and finish are part of the design and should not be considered defects.

We aim to ensure all product descriptions and images are accurate; however, slight variations may occur.

LIABILITY

To the fullest extent permitted by law, GINA MELOSI shall not be liable for any indirect or consequential loss or damage arising from the use of our products or website.

Nothing in these Terms & Conditions shall limit or exclude liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

GOVERNING LAW

These Terms & Conditions are governed by the laws of Germany.
